All That Remains Involved in Bus Accident, Phil Labonte Goes Off on New York State Trooper

All That Remains were involved in a road accident while heading to the final gig of their 2013 tour with Soil, Era and Cry to the Blind. Yesterday (Dec. 15), during wintery weather in New York, a car slammed into the band’s tour bus, putting a huge dent into the luggage compartment. Following the crash, a state trooper asked for the names and dates of birth for each person on board the bus, leading to an angry rant by singer Phil Labonte.

The always outspoken Phil Labonte considers himself a libertarian, but many equate the vocalist with right-wing ideals due to his anti-Obama and pro-gun stances. Labonte also recently “talked crap” on Rage Against the Machine‘s Tom Morello for his support of Barack Obama, although Morello later corrected Labonte, claiming that Obama was too right-wing for the guitarist’s taste.

Right after All That Remains’ tour bus was hit by a car, Labonte posted a picture of the damage on his Instagram page:

Labonte also addressed the crash on his Facebook page, criticizing the state trooper who arrived on the scene:

“Bus just got hit by a car on the snowy NY roads. First thing the state trooper asks for is everyone on the bus’ name and date of birth. We were all in f—ing bed so we have NOTHING to do with this s–t. That f— has absolutely ZERO authority to make that kind of demand. Way to go NY state police. Apparently you’ve never even heard of the 4th amendment.”

As described by Cornell University Law School, the Fourth Amendment reads, “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

After a few of Labonte’s fans questioned whether or not a state trooper asking for names and dates of birth violates the constitution, Labonte went on the defensive in the post’s comments section. Check out the Facebook post for all the comments.
