U.S. Supreme Court Taking on Major Second Amendment Case Over Concealed Carry!
For the first time in over a decade the U.S. Supreme Court has agreed to hear a case concerning the Second Amendment. The news came yesterday (04-26-21) that the SCOTUS will accept the petition to rule on the "New York State Rifle & Pistol Association v. Corlett" case. This will have a major impact on the Second Amendment rights of not only New Yorkers, but the entire country. The question the SCOTUS will be ruling on is centered around concealed carry. Is restricting or denying a citizen's right to carry a firearm in self defense while outside the home in violation of the Second Amendment? That's the basic argument of this case.
The basics of "New York State Rifle & Pistol Association v. Corlett" are that New York state has a "May Issue" law when it comes to CCW (Conceal Carry Weapons) license. In order to obtain a license to carry a concealed firearm in New York you have to show and explain "good cause" and have an actual reason for doing so. You can't just get a CCW for self defense, there has to be some other reason and or cause to justify a license. So in New York you have to be incredibly well connected and have tons of cash to be able to get a CCW.
Most states are "Shall Issue" or even "Constitutional Carry" which means all citizens who are legally able to do so can carry a firearm, or obtain a CCW. Not just the privileged few who can afford it and are well connected. Plus, in most states you don't have to have "Good Cause" or some form of justification to be eligible for a license or to Constitutional Carry. The only cause that should be needed is self defense, period. it's your right to protect yourself regardless of "Good Cause" whatever the hell that means.
Yesterday's announcement was met with all the usual panicked, doom's day, mass hysteria, ridiculous rhetoric and predictions. All the anti-gun groups are up in arms, pun intended. They feel it's bad timing, especially with the recent mass shootings and that the SCOTUS shouldn't be hearing this case at this time. Now's the perfect time in my opinion. The people who live in these restricted states and places deserve the same right to self defense and the Second Amendment as everyone else.
Don't agree? Answer this question honestly and I bet you will. Let's just suppose you were heading into a mall, church, grocery store or movie theater. Right before you walked in someone stopped you and explained that there's a chance that a bad guy with a gun could show up. Then they offered you a gun to protect yourself and others just in case, would you take it? Some would say, "well, I just wouldn't go in I'd leave." Okay, fair enough. But what's going to happen to you and your personal freedoms when everyplace you go the same thing keeps happening? Like it or not that's the world we're now living in.
Not too sure when the SCOTUS will actually hear the case but it could later this year, if not 2022. Eventually it will make it's way to the court and a decision will be made. It's bound to be historic!
