An Oklahoma mother is battling for change when it comes to the state's medical marijuana laws specifically how DHS (Department of Human Services) and child protective services respond to patients' use of medical marijuana. Marijuana prejudice and the use of cannabis to treat various ailments have created quite a bit of controversy and conflict within the state, its agencies, and the medical community itself.

This story centers around a 9-year-old girl who was issued a medical marijuana card by the OMMA (Oklahoma Medical Marijuana Authority) a few years ago to help treat her epileptic seizures.

For the past year and a half plus the girl hasn't had any seizures, the treatment plan and use of medical marijuana were working to manage her symptoms. Unfortunately, the girl had a seizure recently due to an infection and while receiving care at a hospital a doctor there filed a report for medical neglect.

Afterward, DHS got involved and removed the girl from her mother's care and revoked her medical marijuana license despite the fact that it was working to help manage her seizures for the past year and a half.

The mother and daughter were separated for 3 days while DHS, law enforcement, and other agencies discussed the case. Thankfully a judge recently ruled on the case and dismissed it, DHS didn't show the necessary burden of proof required to declare child neglect or medical neglect.

Now the mother is pushing for change and wants to appeal to state legislators and the medical community to end marijuana prejudice and how the state deals with medical marijuana specifically as it relates to minors.

Most if not all of the doctors knew of this girl's troubles and that she was issued a medical marijuana card for treatment. It was only an issue after the girl had a seizure that doctors and DHS claimed neglect.

Now that the case has been dismissed hopefully a solution can be found and this doesn't happen to another Oklahoma family who may have a child using medical marijuana to treat health issues.

There is needed reform and protective rights for both parents and children that must be accomplished to avoid this in the future. And if this girl's use of cannabis was woking her OMMA card needs to be restored.
